Bidding Terms and Conditions

This auction has been organised by Marie Curie. The proceeds raised by this auction will go to Marie Curie. By bidding for any lot, you agree to be bound by these terms and conditions (T&Cs).

1. You must be aged 18 or over to bid for any lot in this auction. All bidders must be capable of forming legally binding relations under applicable law.

2. When you place a bid for a lot, you are contractually bound to complete the transaction if you place the highest/winning bid for that lot.

3. A lot will not be sold if the highest bid for it is below the minimum reserve price.

4. We will endeavour to take payment from the winning bidder at the auction event, but should this not be possible, we will contact the winning bidder to arrange payment by debit card, credit card, bank transfer or cheque within seven days of the auction. A lot will not be delivered until payment in clear funds has been received in full. Ownership to the lot will only transfer after such payment.

5. We reserve the right to cancel, terminate or withdraw this auction and/or completion of any transaction and/or to reject your participation or bid, e.g. if you do not comply with these T&Cs or if circumstances beyond our reasonable control prevent us from delivering a lot.

6. You acknowledge that the description and condition of a lot are consistent with the information supplied to us and that we are not liable for inaccurate or misleading descriptions. Estimates of the value of a lot are given for indicative purposes only. No promise is made that a lot is fit for a particular purpose.

7. All conditions, representations and warranties not expressly set out in these T&Cs are expressly excluded to the fullest extent permitted by law.

8. We are not responsible for any loss, damage, claim or costs associated with you taking part in this auction, the provision or use of any lot, or for any act or omission of any other person (including any person involved with the delivery of a lot to you).

9. Auction lots are not permitted to be re-gifted to any other online or in-person auction without prior agreement from Marie Curie.

10. By agreeing to Gift Aid, you are confirming that you are a UK taxpayer and understand that if you pay less Income Tax and/or Capital Gains Tax in the current tax year than the amount of Gift Aid claimed on all your donations, it is your responsibility to pay any difference. You understand the Charity will reclaim 25p of tax on every £1 that is given. Gift Aid on lots is only applicable in a limited number of situations; the Charity will claim wherever possible; for more info see www.hmrc.gov. uk/ charities/gift_aid/rules/auctions. htm

11. If any part of these T&Cs is found by a court to be invalid, illegal or unenforceable, that part will be discounted and the rest of the T&Cs will continue to be valid to the fullest extent permitted by law.

12. We do not accept payment by CAF voucher for any auction lots.

13. These T&Cs are governed by Scottish law and the courts of Scotland will have exclusive jurisdiction in the event of any dispute.
